CS Najib Balala Very Sick To Appear In Court…What’s Happening To Our Leaders?

Mining Cabinet Secretary Najib Balala failed for the third time to honor court summons to show cause why he should not be jailed for declining to release a confiscated mineral shipment after he was ordered to do so.

The CS, who was expected to appear before Justice Eric Ogola, instead sent state lawyer Mwangi Njoroge to present a letter showing that he was “very sick” thus his absence to answer charges of disobeying court orders.

Najib Balala disregarded a court order directing him to release 12 containers in September last year belonging to Stema Alloys Enterprises that contain Malachite. The cargo was to be shipped to South Korea but the CS claimed that the owner did not have an export license.

Balala and the Commissioner of Mines and Geology Shadrack Kimumo where to initially appear before High Court judge Francis Gikonyo on December 5 but failed to do.

Fred Athouk, who is the company’s lawyer, told the court that the CS had disobeyed the order requiring him to release the ship carrying the malachite as ordered by the court.

The matter will be heard again on February 2.
