His condition is said to be so bad that the lawyer and family members were denied access to see him. The lawyer now wants the court to order that Simon Wambugu be taken private doctor to receive treatment at his own cost.
The defense lawyer said:
“I personally have been denied access as well as members of his family who had brought him food, he has been seriously tortured in attempts to extract an admission… this type of conduct will ultimately result in a mistrial.”
The Resident Magistrate directed that the suspect be taken to Kenyatta National Hospital and a detailed report on his condition availed to court. She went on to direct the police to allow his lawyer to access him.
The suspect is still in custody as per the request of the prosecution to help with ongoing investigation.
“The application by the prosecution for extended custodial period is well founded as investigations are incomplete, the suspect faces capital charges alongside others and may be flee the court’s jurisdiction,” The magistrate directed.
